This requirement was not met due to the observation, inspection, and interview with Director, revealed the failure to post the Notice of Site Visit for the required 30 days for visit conducted on 04/10/2024.
Based on interview and record review , the licensee did not comply with the section cited above in Director stated that they conduct it every 6 months but there was no documentation which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on record review the licensee did not comply with the section cited above, Director and Staff 3 did not renew the Mandated reporter training which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on record review, the licensee did not comply with the section cited above, Staff 2, Carissa Gonzales' Criminal Record Clearance is not associated with the Facility which poses an immediate health, safety or personal rights risk to persons in care.
(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.
(a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons.
Based on interviews conducted with staff and parents revealed staff #7 was observed to inappropriately handle and speak to child #1. It was also found at least 3 children were not provided enough snack & at times would eat the crackers from the ground. One of the staff told the lead staff to give the children more.
Any unusual behavior, any injury or signs of illness requiring assessment and/or administration of first aid by staff shall be reported to the child's authorized representative and recorded in the child's record. This requirement is not met, as evident by Based on IB investigators’ observations, interviews, and documents collected during the investigation, The failure to promptly notify the parents is considered a violation of the facility’s responsibility to ensure appropriate communication regarding children’s well-being.
(a) (4)(5) & (6) Food Service: Between meals, snacks shall be available for all children unless the food a child may eat is limited by dietary restrictions prescribed by a physician. Each snack shall include at least one serving from each of two or more of the four major food groups. (5) The following shall be offered daily: (A) Full-day programs shall offer a midmorning and a midafternoon snack. (B) Full-day programs shall ensure that each child has a lunch. 1. The child's authorized representative may send meals and/or snacks for the child. (C) Half-day programs shall offer a midmorning or midafternoon snack. (6) Menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request. his requirement is not met as evidenced by: Based on record review of Parent Handbook 2023-2024, parent interviews, and staff interviews revealed the center has not met the above requirement:
Any form of discipline or punishment that violates a child's personal rights as specified in Section 101223 shall not be permitted regardless of authorized representative consent or authorization. LPAs utilized photo that was taken of C3 as part as evidence to this investigation. Also former staff stated S3 would harm children in care. Additionally the department received statements from a parent and former staff, alleging S3 took away lunch as a form of punishment.

Through IB investigation, documents and interviews revealed, C47 was not provided healthull accomodations when C47 injured their wrist.
Personal Rights: The licensee shall ensure that each child is accorded the following personal rights: To be accorded dignity in his/her personal relationships with staff and other persons. To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met based on documents collected and interviews with the witnesses who stated they observed staff #3 inappropriately restrain a child and heard staff #3 make inappropriate intimidating statements to children in care.
The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. this requirement was not met as evidence by... document review for 04/16/2024, 04/18/2024, and 5/10/2024, the preschool was found to be out of ratio compliance.
(a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. Based on LPAs' observations, interviews, and documents collected during the investigation, LPA received statements from staff and parents describing the violation of perosnal rights of children, in particularly multiple statements revealed, a red mark wa sobserved on C3 cheek.

Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such This requirement was not met based on documents collected and interview with the staff who stated there was a incident on 3/27/2024, between C#3 and C#4. Documents collected revealed a incident on 5/17/2024, when C#15 was able to exit the the preschool through an open gate. Staff did stop C#15 at the bench.

The parent of C#4 was not made aware of the incident when it occurred and was provided ouch report on 4/18/2024 which is signed by parent dated 4/18/2024.
