Based on observation and interview, the licensee did not comply with the section cited above when a newly built pool containing water was absent of a fence, wall, or other barrier surrounding the body of water which poses an immediate health, safety or personal rights risk to persons in care. Today an immediate civil penalty of $500 is hereby assessed.
Resolution: Licensee will have a pool barrier company expedite the installation of a retractable mesh fence that is compliant with the American Society for Testing and Materials (ASTM) International Standard F2286 that completely surrounds the pool and is installed by the above date.
