Based on observation and interview, the licensee did not comply with the section cited above. LPA observed two buckles to the above ground spa that were broken. The water was still inacessible to children as the cover was hard to lift and it created an approximately 3 inch opening in the area where the buckles were broken at when lifted. This poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licesensee stated she would replace the buckles on the spa to ensure it was no longer defective and continuously inspect the spa cover for any sun damage on the buckles or cover.
