staff # 1's admission that she has not following the menu and LPA's observation that the menu stated egg sandwich for lunch and vegetable soup was served on 12/7/21. This is a potential risk to the health and safety of children in care.

Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. Based on LPA observation and interview with S3, the playground gate has not been repaired. The facility continues to utilize a self-made PVC latch to keep children from leaving the playground. This poses and a risk to the children in care

interviews that adult # 1 worked at the facility on Wednesday 11/17/21, Thursday 11/18/21, and Friday 11/19/21 for two or three hours. Monday 11/22/21, Tuesday 11/23/21, and 11/24/21 for two or three hours. There were no paperwork on file for adult # 1 for the above requirement. This is a potential risk to the health and safety of children in care.

(c) Admission Agreement- The licensee, or his/her designee, and the child's authorized representative shall sign and date the child's admission agreement no later than seven calendar days following admission. This requirement was not met as evidenced by reviewing 20 children's files, finding 7 files did not have either a copy of the contract or did not have signature of the parents on file. This is a potential risk to the health and safety of children in care.

While touring the facility at 2:02 pm, LPA observed Natalia Kreslina caring for 12 children during nap time inside classroom # 102. LPA asked Natalia Kreslina how long she has been employed at Merry Hive Preschool. Natalia stated she has been working at the facility since September 2022 as an assistant. file records indicated a transfer request was never made which poses an immediate health, safety or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Based on LPA observations, video recording, interview with Director, S1 and S2 who all stated C1 was missing and unsupervised for five minutes. This poses an immediate risk to the safety of the children in care.
