Based on records review and interview, the licensee did not comply with the section cited above in 2 of 2 licensee's, which poses/posed a potential health, safety or personal rights risk to persons in care. The records review shows the licensees don't have a current mandated reporter in file. The licensee stated both licensees have to renew the mandated reporter.

Based on observation and interview, the licensee did not comply with the section cited above in 5 of 5 children in attendance, which poses/posed a potential health, safety or personal rights risk to persons in care. The licensee's sing in/out sheets don't have a full legal signature for any of the children in attendance. The licensee stated that parents sing at the end of the month.

Based on interview statements, the licensee left chemicals in the daycare area accessible to children in care. This poses an immediate risk to children in care.

.1 Teacher Qualifications and Duties. (j) Each teacher shall visually observe aides under his/her supervision whenever the aide is working with children, except as provided for in Sections 101216.2(e)(1) and 101230(c)(1). This regulation was not met as evidenced by: Based on LPA's observation on 11/14/24 S2 was supervising a few daycare children alone. Records review show S2 was not teacher qualified. This poses a potential risk to the health and safety of children in care.

Based on observation and interview, the licensee did not comply with the section cited above in 3 of 3 water outlets, which poses/posed a potential health, safety or personal rights risk to persons in care. The director stated the facility has not been tested for lead. The facility has three faucets, one is portable.

Based on an interview with the licensee, the licensee did not comply with the section cited above in 1 of 1 drill every six months, which poses/posed a potential health, safety or personal rights risk to persons in care. The licensee stated that because the facility just recently enrolled children, no disaster drills have been conducted.

.7995 Employees or volunteers at day care center; immunization requirements; records; exemptions (a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Based on records review and interviews, the licensee did not meet the regulation above. The LPA observed S3 providing care and supervision to daycare children. This poses a potential risk to the health, safety, and personal rights of children in care.

Based on interview statements, the licensee failed to adhere to the licensing terms when daycare staff were allowed to care for an unenrolled infant. The license was granted for preschool children ages 2 to 6. This poses a potential risk to children in care.

(a) Buildings and Grounds. The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This regulation was not met as evidenced by: Based on observation and interviews, the director did not ensure a broken mirror was repaired. Tape was not placed on the broken mirror and a repair order was not provided during the visit. This poses a potential risk to the health, safety, and personal rights of children in care.

Based on observation and interview with the licensee, the licensee did not comply with the section cited above in 6 of 6 rugs, which poses/posed a potential health, safety or personal rights risk to persons in care. The LPA observed the rugs are stained with dark substance that appears to be dried mud or dried up liquid. The director stated the rugs got dirty during rain season and that some stains are pemanent.

Based on observation and interview, the licensee did not comply with the section cited above in 3 of 3 water outlets, which poses/posed a potential health, safety or personal rights risk to persons in care. Each personnel record shall contain the following information: ... This regulation was not met as evidenced by: Based on records review, the director did not ensure personel records are maintained in the facility as required. S3 did not have the required documents in file. Missing were health screening and tb test. This poses a potential risk to the health, safety, and personal rights of children in care.

Based on interview statements, 2 out of 4 teachers stated S2 was vaping inside the child care center. This poses a potential risk to the children in care.

Based on observation and interview with the licensee, the licensee did not comply with the section cited above in 6 of 6 rugs, which poses/posed a potential health, safety or personal rights risk to persons in care. The LPA observed the rugs are stained with dark substance that appears to be dried mud or dried up liquid. The LPA observed empty plastic bags, an all purpose bag sand, empty water bottles, and other broken plastics in the playground.
