Based on observation, the licensee did not comply with the section cited above due to the height of the deck fence not meeting the required height of 5' tall from a standing vantage point, which poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Licensee stated they will add further construction that raises the fence height to 5' tall and ensure that the fence meets all other licensing requirements. LPA will return to conduct a plan of correction visit.
Based on observation and interview, the licensee did not comply with the section cited above in the case of an infant sleeping in a play yard that had objects laid over the top of the play yard for the purpose of keeping the infant in the play yard. This poses an immediate health, safety, or personal rights risk to persons in care.
Resolution: LPA provided resources for safe sleep regulations that licensee will review and provide a written statement by the POC due date acknowledging that they understand and will abide by all regulations. LPA will conduct return visit to ensure compliance.
