Based on observation, interview, record review. The licensee did not comply with the section cited above Child #1 medications in storage was expired 6/2024, which posed a potential health, safety or personal rights risk to persons in care.

Based on interviews with complainant party, staff and images provided C4 sustained red marks on right side cheek and chin by S2 grabbing C4’s chin with S2 hand. This poses an immediate Health and Safety risk to the children in care.

Director stating to RP and LPA during interview that subject child did not need a Shadow while in care and would create a new policy that will not allow such services at their campus. This is a potential risk to the health, safety or personal rights to the children in care.

(d)(1) Reporting Requirements (d)Up... (d)(1)... a report shall be made... by telephone... next working day and during its normal business hours...a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days... This requirement is not met as evidence by: Based on interview with director, director failed to report incident to licensing office within 24 hours. This poses a potential Health and Safety risk to the children in care.

Based on record review, the licensee did not comply with the section cited above in four out of ten staff files reviewed were missing proof of immunization, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, interview, and record review, the licensee did not comply with the section cited above in no staff member present possesses have current EMSA approved Pediatric CPR/First Aid certifications, which poses/posed a potential health, safety or personal rights risk to persons in care.

Reporting Requirements: (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone...(1) Events reported ... (C) Any unusual incident This requirement was not met as evidence by records reviewed and director stated during interview that this incident was no reported to their local licensing office. According to records the incidents on 12/06/2022, 12/13/2022 and 12/16/2022 were reported to the authorized representative but not CCLD-CCP.

Based on observation and record review, the licensee did not comply with the section cited above in 8 out of 10 staff files reviewed were missing or have expired mandated reporter training, which poses/posed a potential health, safety or personal rights risk to persons in care.

Admission Agreements- (f) The licensee shall comply with all terms and conditions set forth in the admission agreement. This requirement was not met as evidence by receords reviewed and interview condcuted revealed that the facility did notr provide a full refund payment upon termination of the admissions agreement to the authorized representative.
