(a)(1) Responsibility for Providing Care & Supervision: No child(ren) shall be left without the supervision of a teacher at any time.... Supervision shall include visual observation. This requirement is not met by: Based on observation, interviews, and medical records review, staff who were present at the playground did not provide adequate supervision: did not see/prevent C2 kicking C1, causing C1 to be injured. This poses a potential risk to the health, safety, and person rights of the children in care.

The licensee did not comply with the regulation above as evidenced by: Based on records review and interviews, the director did not have a current roster of children in care during the unannounced visit. The director has class rosters without the required information that would appear in the LIC9040.
