Teacher Mr. Valadez stated that a child was left in the classroom alone for about 35 to 40 minutes while everyone was in the playground. This poses an immediate health, safety, or personal rights risk to children in care.
Based on record review, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. Licensing Program Analyst (LPA) observed that four staff members were missing Health Screening reports.

During the indoor inspection of both classrooms, Licensing Program Analyst (LPA) observed that the rugs used for circle time had dark stains and appeared not have been shampooed for some time. The blue carpet in both classrooms also appeared stained in some areas.

(a)(3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain . . . including eating, sleeping or toileting; or withholding of shelter, clothing, medications or aids to physical functioning. This requirement was not met as evidenced through interviews with staff, which indicated that a contracted employee from an outside agency aggressively handled a child during classroom hours. This poses a potential risk to the health, safety, and personal rights of children in care.

(b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required. This requirement was not met evidence by: Based on record review provided by LA Testing indicating (ALE) of 6.87 ppb in outlet F in Room 11. These results indicate out of compliance over (ALE) 5.5 ppb, which poses a potential health, safety or personal rights risk to persons in care.
