Licensee failed to submit proof to the Department verify that the Principal (Site Supervisor), Staff #1 meets the director qualification showing that this facility has a director. This poses a potential health, safety, or personal rights risk to children in care.

LPA observed Child #1 (C1) was in the restroom stall by himself as the teachers were in the classroom floor with the other children. LPA observed C1 was in front of the toilet, but he pooped, and his poop appeared to be on himself and on the restroom floor. LPA then called the staff to come over to the restroom as C1 had an incident in the restroom. LPA observed the classroom has a door open to the short hallway leading to the children's two restroom installs. As LPA was standing by the second restroom stall door, LPA was not able to observe the classroom or have vision of the classroom; therefore, a teacher did not have vision supervision of C1 in the second restroom stall by himself which poses an immediate health, safety, or personal rights risk to persons in care.

(b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required. This requirement was not met evidence by based on record review provided by Licensee indicating ALE of 6.89 ppb in (outlet C playground bubbler) and (ALE of 5.64 ppb in outlet D playground bubbler). These results indicate out of compliance over (ALE) 5.5 ppb, which poses a potential health, safety or personal rights risk to persons in care.
