Based on interviews, the licensee did not comply with the section cited above. The facility is co-mingling school age and preschool children at the end of the day as the children are waiting to be picked up from the facility which poses a potential health, safety or personal rights risk to persons in care.

Based on interviews and record review, it was revealed that an incident occurred on 07/28/2023, where Staff #1 and Staff #2 were engaged in a verbal altercation in front of day care children during operating hours. This poses a potential health, safety or personal rights risk to persons in care.

Based on staff statements, it was revealed that staff failed to visually monitor all children during outside activities, which poses a potential risk to the health, safety, and personal rights of children in care.

Based on interview and record review, the licensee did not comply with the section cited above, in that two of five staff files did not contain LIC 503 - Health Screening Report, which poses a potential health, safety or personal rights risk to persons in care.

Based on interview statements, it was revealed that the facility was out of ratio on April 10, 2025, which poses a potential risk to the health, safety, and personal rights of children in care.

No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Based upon staff interviews, Staff entered the classroom without a child and realized there was a child missing the after door was closed. Due to lack of supervision this poses as an immediate risk to the health and safety of the children in care.

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of punitive nature… Based upon staff interviews, staff aggressively grabbed the child’s face and the incident was not address immediately. Due to lack of personal rights this poses as a potential risk to the health and safety of the children in care.

Reporting Requirements…(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department…(1) Events reported shall include the following…(C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidence by: Based on interview, it was revealed that staff failed to report an unusual incident to Licensing which poses a potential risk to the health, safety, and personal rights of person in care.

Personal Rights…(a) The licensee shall ensure that each child is accorded the following personal rights…(2) To be accorded safe, healthful and comfortable accommodations…to meet his/her needs. This requirement was not met as evidence by: Based on interviews, it was revealed that staff did not prevent inappropriate behaviors between children. This lack of personal rights poses a potential risk to the health, safety, and personal rights of person in care.
