Based on observation, the licensee did not comply with the section cited above. Facility did not have proof that their drinking and cooking water have been tested for lead contamination levels on or after January 1, 2020 but no later than January 1, 2023 which poses a potential health, safety, or personal rights risk to persons in care.

Personnel Requirements: (k) The licensee or designated individual shall instruct all personnel to report observations or evidence of violations of any of the personal rights specified in Section 101223. Based on observation, the licensee did not comply with the section cited above. During the interview, it was disclosed that a staff member observed a child who was crying, upset and child disclosed that child bump child’s head. The incident was not reported to the designated individuals. It was discovered that child sustained another injury result from the fall that child bumped child’s head. This poses a potential health, safety, or personal rights risk to persons in care.

Based on investigation, licensee failed to meet the safety needs of all children and failed to follow their own disciplinary policies/procedures to ensure health and safety for all is met. This poses a potential risk to the health, safety, or personal rights of children.

Based on observation, the licensee did not comply with the section cited above. LPAs observed Classroom 1, Classroom 2, and Classroom 4 did not have a working carbon monoxide detector that meet the standards which poses a potential health, safety, or personal rights risk to persons in care.

(f) At least one staff member who is trained in pediatric cardiopulmonary resuscitation and pediatric first aid pursuant to Health and Safety Code Section 1596.866 shall be present when children are at the child care center or offsite for center activities.

(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test.

This regulation was not met as evidenced by: On multiple occasions Staff #1 and #2 did not ensure the personal rights of persons in care to safe and healthful accommodations in that facility staff did not properly wear face coverings while in the facility as required by the CA Dept. of Public Health Guidance on the Use of Face Coverings issued June 18, 2020 and updated Nov. 16, 2020, and an individual mask exception did not apply.

During the case management inspection, it was confirmed that staff members failed to ensure that a daycare child was released to the right authorized representative. As staff discovered that the child was released to the wrong authorized representative, staff went after the authorized representative and observed that the child was already inside the authorized representative’s vehicle. This poses an immediate risk to the health, safety, or personal rights risk to persons in care.
