Based on observation, interview, and record review, the licensee did not comply with the section cited above as assistant present during today's inspection has an eligible clearance but was not associated to the facility, which poses an immediate health, safety or personal rights risk to persons in care.
Resolution: Licensee filled out LIC 9182 Criminal Background Clearance Transfer Request form and submitted the form to LPA prior to the end of the inspection. LPA will complete the transfer request as soon as possible. LPA discussed fingerprint clearance requirements, including transfer of exisiting clearances, to her facility prior to the individual's presence in the home.
