Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature. This requirement was not met as evidence by: It was observed that S1 physically restricting C1 by the upper right bicep, which caused a bruise. The is an immediate Health and Safety risk to children.

Based on documents provided, the licensee did not comply with the section cited above due to the facility was tested after 01/01/2023, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on LPA's observation licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2 (e)(1) and 101230(c)(1). Super- vision shall include visual observation. This requirement was not met as evidence by: Staff admitted to leaving a child without direct supervison for approximately 4 minutes. This poses an potential health and safety risk to the children in care.

The director had knowledge of a child not supervised/left unattended and failed to report the incident to the Department.
