Based on record review the licensee did not comply with the section cited above in one assistant, Elani, had a criminal record clearance, however she was not associated to the facility which poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee states the employee has a clearance (LPA observed a copy) from another day care and they wanted her transferred to Galin's day care. They could not process the transfer through the Guardian system stating it was too confusing. She also called the Licensing Department and the office staff said they would complete it and did not. LPA reminded that the employee cannot be present in the facility until the transfer or fingerprint clearance has been processed. The employee shall be transferred to the facility by POC date of 4/6/22.
