(1)An aide who is 18 years of age or older, and who meets the requirements of this section and Section 101216, may escort and/or assist children in going to the bathroom, and may supervise napping children as specified in Section 101230(c)(1), without being under the direct supervision of a teacher. This requirement was not me as evidenced by: Based on records review of timecards, schedules, sign in and sign out sheets and interviews it was proven that a teacher aide provided supervision of children on several occasions over a period of two weeks during January 13-26, 2021, when the children were awake, without being under the direct supervision of a teacher. There was not enough qualified staff clocked in during January 13-26, 2021, to cover breaks and lunches for the number of classrooms open and the children present, as the substitute director did not always cover the breaks and lunches.
