GONZALEZ FAMILY CHILD CARE

Based on observation, the licensee did not comply with the section cited above in LPA observed poisons, toxins, drinking alcohol, medications in open areas of the garage open to daycare children; kitchen knives and clorox spray cleaners and wipes in lower kitchen cabinets, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children and submit proof of the correction on or before close of business day 01/19/2024, by fax or e-mail.

Based on observation, interview and record review, the licensee did not comply with the section cited above in 2 staff present and working with children did not receive a criminal record clearance prior to working with children, 3 additional staff not present are subject to a criminal record review, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure all individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility and submit proof of a livescan receipt for employees, and submit proof of documentation to the department by mail or e-mail before the close of business day on 01/19/2024.

Based on observation interview, the licensee did not comply with the section cited above in the licensee failed to ensure one or more carbon monoxide detectors in the facility that meet the standards were installed in the home which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure one or more carbon monoxide detectors in the facility that meet the standards established in Chapter 8 (commencing with Section 13260) of Part 2 Division 12, and submit proof of the installed device on or before close of business day on 01/22/2024.

Based on observation and interview, the licensee did not comply with the section cited above in the licensee by admission stated they removed equipement to barricade stairs in the home, where 9 children under 5 years of were present at the facility which poses posed a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure the home shall be free from defects or conditions which might endanger a child and where children are less than five years old are in care, stairs shall be fenced or barricaded. The licensee also agrees to submit proof of a barricade for stairs by fax or e-mail by 01/22/2024.

Based on observation, the licensee did not comply with the section cited above, the licensee failed to ensure 4 play yards for 4 infants present and in care were free from blankets and toys, which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure cribs or play yards shall be free from all loose articles and objects and submit a written statement of understanding for the licensee and staff, regarding the Infant Safe Sleep standards. The licensee agrees to submit the written statement by fax or e-mail on or before close of business day 01/19/2024.

Based on record review, the licensee did not comply with the section cited above in the licensee failed to ensure facility employees complete the mandated reporter training withing 90 days of hire, and the licensee failed to complete a renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training, which expired in 09/2023 and which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure employees of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training on or before 02/19/2024, then submitt proof of their training certificates to the department by fax or e-mail.

Based on record review, the licensee did not comply with the section cited above in the licensee failed to obtain the LIC627 Medical Consent from the authorized representative of a child in care which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure all required documentation to include medical consent is maintained for each child in care and provide proof of the LIC627 Medical consent for a subject child on or before 01/22/2024 or the next time the child is in care, by fax or e-mail.

Based on record review, the licensee did not comply with the section cited above in the licensee failed to maintain sleep logs for infants under 24 months of age, enrolled at the facility which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to submit proof of infant sleep logs with 15 minute checks for infants in care and submit proof of documentation on or before close of business day on 01/22/2024.

Based on record review, the licensee did not comply with the section cited above in the licensee failed to obtain immunization records for a child present and in care, which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to submit proof of immunization records for a subject child enrolled and receiving care at the facility and send proof of documentation to the department on or before 01/22/2024 by fax or e-mail.

Based on record review, the licensee did not comply with the section cited above in the licensee failed to ensure 2 employees present and working with daycare children have been immunized for measles, pertussis and influenza or have submitted a letter to decline influenza, nor have the staff completed a screening for Tuberculosis, which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure all employees or volunteers at family day care home; immunization requirements; records; exemptions and a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year, and complete screenings for Turberculosis, and submit proof to the department on or before 01/22/2024.
