(1) The center shall give each authorized representative a copy of the Personal Rights form (LIC 613A [9/96]).

.3(b)(1) (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement was not met as evidence by: Based on record review the licensee did not ensure water sources at facility meet lead requirements. Lead test results showed that 10 water sources have an action level exceedance. LPA observed water sources have had filter added or are off and inaccessible to children.

Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision ... (1) No child(ren) shall be left without the supervision of a teacher at any time, ... Supervision shall include visual observation. This regulation was not met as evidenced by: Based on LPA observation and interview, Licensee did not have full supervision of child resulting in child leaving classroom for a period of 5-10 minutes and entering elementary school classroom. This poses an immediate health, safety, and personal rights risk to children in care.

Based on record review, the licensee did not comply with the section cited above in 4 of 11 which poses a potential health, safety or personal rights risk to persons in care.

(a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents.

Based on record review, the licensee did not comply with the section cited above in 4 of 11 which poses a potential health, safety or personal rights risk to persons in care.

Based on interviews, it has been confirmed that childrens personal rights have been violated by forcing a child to sleep, which poses a potential health and safety risk or personal rights risk to children in care.
