Based on observation, interview, record review, the licensee did not comply with the section cited above in one of two staff present did not have documentation of TB screening and Pertussis (TDap) on file, which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year; and submit verifiable proof of a TB screening and vaccination for pertussis. The licensee also agrees to submit proof of documentation by fax, mail or e-mail.

During the facility tour the LPA observed Trader Joes 2% milk in the fridge. The Licensee stated she provides the 2% milk to the children in care. Licensee stated per the food program the children must be given 2% milk. After reviewing the food program guidelines with the Licensee, the guidelines state, “1% milk…”.

Resolution: Licensee understands lowfat (1 percent) milk or nonfat milk must be served to the children in care. Licensee will submit a written statement on how she plans to remain in compliance.

Based on the record review, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. During file review of S2 the LPA was unable to review a current Mandated Reporter certificate for S2. Licensee understands Mandated Reporter training must be completed every two years.

Resolution: Licensee agrees to have S2 complete the Mandated Reporter training and submit the certificate of completion to the Department on or by POC due date of 7-15-2024.
