Based on observation, interview and record review, the licensee did not comply with the section cited above in the licensee exceeded their licensed capacity and approved fire clearance by operating with 15 children in care, which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure the regulation for a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10 and submit a written plan of action to ensure the capacity does not exceed their fire clearance and licensed capacity, by fax, mail or e-mail.

Based on record review the licensee did not comply with the section cited above in the licensee was unable to provide proof of the renewal mandated reporter training for mandated reporter after expiration on 06/30/2025, which poses a potential health, safety or personal rights risk to persons in care.

Resolution: The licensee agrees to ensure the licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training and submit proof of training certificate by fax, mail or e-mail.

Resolution: Licensee understands all individuals working with the children in care must have a current Mandated Reporter certificate on file. Licensee agrees to have S1 complete Mandated Reporter and agrees to submit the certificate of completion to the Department on or by POC due date of 7-30-24. Training can be completed at www. Resolution: Licensee understands at least one person at the facility must have taken an EMSA approved CPR/1st training. Licensee agrees to complete an approved training and submit completion of training to the Department on or by POC due dated 7-30-24.

During the facility tour LPAs observed a child sleeping in the garage which is an off limits area. During the file review the fire clearance was reviewed and states, “… was advised the occupancy of a garage does not permit living and/or child care activities."

Resolution: Licensee agrees to submit a written statement of understanding of the Fire Clearance.

Upon arrival LPAs observed S2 and S4 in the outside play area with a group of children. During the facility tour S2 disclosed there was a sleeping baby in the garage. LPA observed C2 behind a closed door in an off limits garage.

Resolution: Licensee agrees to submit a written statement of understanding of the regulation.
