Based on observation the licensee did not comply with the section cited above as LPA observed that sections of the pool enclosure was removed and the remaining enclosure had sections that were the bottom is more that 2 inches from the ground, passages greater than 4 inches, and is no longer fully enclosed which poses an immediate health, safety or personal rights risk to persons in care.

Resolution: Licensee will have the gate enclosure installed back to the previous location on 6/19/2025. The facility will be closed on 6/19/2025 and reopen on 6/20/2025 unless the the gate is not fully restored. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.

Based on record review, the licensee did not comply with the section cited above as licensee states that although daily inspections of the pool safety features are condcuted, the inspections are not logged/documented which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will log/document daily inspections and send a copy of the log to CCL by 6/27/2025. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.

Based on record review the licensee did not comply with the section cited above as 1 assistant did not fully complete the fingerprint process after an invalid facility number was put on the livescan form which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee will have the assistant fingerprint again on 6/19/2025. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.

Based on record review, the licensee did not comply with the section cited above as the licensee and 2 assistants do not have current mandated reporter training which poses/posed a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee and 2 assistants will complete the training and submit copies of the certificates to CCL by 6/27/2025. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.
