Based on observation, the licensee did not comply with the section cited above in that the vertical clearance from the ground to the bottom of the enclosure is 3 inches which poses/posed a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee stated they will fix fencing to meet regulations. Licensee will advise LPA once fencing has been fixed so LPA can conduct visit to clear deficiency. Licensee stated the backyard will be off-limit until the fencing is corrected.
