Resolution: Licensee agreed to have Staff 1 fingerprinted. Staff was fingerprinted in January 2023, Guardian requested additional documentation from the applicant and documentation was never received. Staff 1 left during LPA visit and will not return until clearance is granted. Licensee will write a letter of understanding in regards to HSC 1596.871 and submit it to Licensing by POC date.

Based on interview and record review, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. Facility was operating out of ratio on November 1, 8, 9, 10, 16 and 17 with more than 12 children and up to 14 children attending at the same time and all of the children are younger than 5 and none of them is enrolled in kindergarten or transitional kindergarten yet as stated by assistant provider Dalinda Ramos.

Resolution: Assistant provider Dalinda Ramos understands that the facility should immediately cease operating out of ratios. Facility is to rearrange child care schedules to ensure that proper ratio is maintained at all times. Written statement and child care schedule for each of the children in enrollment will be submitted by next business day on 11/22/2021.

Per drill log, last drill was conducted in February 2019. No other drill log for review as stated by assistant provider Dalinda Ramos.

Resolution: Assistant provider Dalinda Ramos agreed to conduct fire drill and disaster drill with children and submit drill log by 11/26/2021.

Hazards including prescription medications, over-the-counter medications, supplements stored in kitchen, laundry solutions stored in laundry room, toothpaste and deodorant stored in the bedroom adjacent to the hall bathroom are accessible to children. Whipped cream with label "Could be fatal" stored in refrigerator in kitchen is accessible to children.

Resolution: Assistant provider Dalinda Ramos agreed to store all hazards inaccessible to children and submit pictures and written statement as proof of corrections by next business day on 11/22/2021.

Immunization records for Staff 2 and Staff 3 are not available for review during inspection. Assistant provider Dalinda Ramos stated that no other records are available for review at the time.

Resolution: Complete immunization records will be submitted to the Department by 12/3/2021.

Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. LPAs observed 4 assistant providers supervising children during the inspection. However, there are no LIC508 Criminal Record Statement available for review during inspection. Assistant provider Dalinda Ramos stated that no other records are available for review at the time. During inspection, Staff 1 completed the LIC508.

Resolution: Signed LIC508 Criminal Record Statement completed by each of the assistants will be submitted by 11/22/2021.

Based on interview and record review, the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care. As stated by assistant provider Dalinda Ramos, licensee admitted to not renewing the training after the training expired on 8/19/2020. Staff 2, 3 and 5 who are present during inspection have not completed the training.

Resolution: Licensee and staff will completed the required ASB1207 Mandated Reporter Training and submit proof of training by 11/26/2021.

Based on observation and interview with the provider, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. The garage was off limits as stated at the prelicensing inspection by the licensee. However, LPAs observed children napping the garage during inspection. LPAs observed that the garage is set up as a child care room with tables, chairs, child care furniture and toys there. Assistant Dalinda Ramos stated that children nap and eat in the garage which is a violation of the fire clearance.

Resolution: Assistant provider Dalinda Ramos agreed to cease using the garage for child care. Assistant provider agreed to submit pictures and written statement as proof of correction by next business day on 11/22/2021.
