Based on interview, the licensee did not comply with the section cited above by providing care for over eight children without an assistant present which poses an immediate health, safety or personal rights risk to persons in care. Licensee informed LPM/LPA that she has provided care for 13 children alone for 4/5 months, due to not having a reliable assistant.
Resolution: Licensee stated she willl not take over 8 children, if there is no assistant present. Licensee has hired an assistant. LPA will conduct return visit to ensure capacity is met and review records for assistant.
