Based on observation, interview, and record review, the licensee did not comply with the section cited above. Licensee and 2 assistants have not completed their mandated reporter renewal training. Last completed was on 09/2022. Licensee stated her and the 2 assistants will renew their certificates.which poses potential health, safety or personal rights risk to persons in care.

Resolution: Licensee and both assistant will renew their mandated reporter training and send LPA Jimenez proof of completion by 10/28/24.

Based on observation, the licensee did not comply with the section cited above in that LPA observed a hole in a segment of mesh net pool fencing. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated she shall fix the fence and cover the hole in accordance to Title 22 regulations by the given due date. In the meanwhile, licensee has closed and locked both doors that lead directly to the backyard and has placed a piece of wood in front of the fence to cover the hole.

Based on record review, the licensee did not comply with the section cited above in that S1 did not have any immunization records on file. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: Licensee stated she shall submit immunization records for S1 by the given due date.

LPA met with Licensee, Silvia Escobar. Also present was her assistant and her daughter, that was called to help interpret. LPA conducted a tour of the home, inside and outside, as shown on the facility sketches (LIC 999A) provided. The LPA observed all required licensing forms to be posted in a visible location for authorized representatives to view them. A census was taken and there were eight day care children present. No pets were observed during today's visit. The LPA observed inaccessible rooms to be off limits to children by the use of door knob spinners. The accessible rooms were the downstairs bedroom/play room, downstairs bathroom, living room and kitchen. The outdoor play area in the back yard is fenced. Licensee is aware that children are to be supervised when outside an unfenced play area. Swimming pool is fenced per regulation. The LPA observed safe toys and play equipment both indoors and outside. There were no poisons observed on the premises accessible to children. Licensee is aware that poisons are required to be locked and inaccessible to children. Cleaning compounds, medications and other hazardous items were inaccessible to children. There are no firearms or ammunition present at this facility. There is no fireplace. There is a working fire extinguisher, smoke detector, carbon monoxide indicator, and adequate heating and ventilation for safety and comfort. The licensee has a complete first aid kit, including bandages, scissor, thermometer, gloves and a first aid manual. Stairs are barricaded when children under age 5 years old are present. There is a working telephone and the above telephone number was verified. Adequate supervision is being provided during this visit. Capacity as specified on the license is being maintained. LPA reviewed six children’s files. All required licensing documents were observed in each of the children’s files, including a copy of the Family Child Care Home Notification of Parent's Rights (LIC 995A). Licensee also maintains documentation of immunizations for the children, but not all immunizations were transcribed onto cards. Based on record review, the licensee did not have an Individual Sleeping Plan in one of the infants files. This poses a potential health, safety or personal rights risk to persons in care.

Resolution: The liocensee agrees to have a complete Individual Sleep Plan available for review, for each infant in care, by the due date of 10/18/21.

Based on observation the licensee did not comply with the section cited above as the LPA observed the licensee place the infant in care, once they fell asleep, in a swing instead of a crib on their back. This is a potential health, safety or personal rights risk to persons in care.

Resolution: The LPA had the licensee remove the infant from the swing and place them in the crib. The licensee agrees to review the regulations on Safe Sleep requirements and write a statement on what those guidelines are. The licensee will also attend a training on Safe Sleep when one is available.
