Based on observation, the licensees did not comply with the section cited above. LPA observed an in-ground swimming pool in the backyard where children have access. Per Licensees, the installation of their in-ground swimming pools in the backyard started in November 2023 and completed around January 2024. Licensees failed to notify the Department of the installation of the in-ground swimming pool; therefore, it poses a potential health, safety, or personal rights risk to children in care.

Resolution: Licensees were informed of childcare training videos available on the Community Care Licensing (CCL) website at www.ccld.ca.gov. Licensees agreed that they will watch the following videos: Bodies of Water Requirements in Child Care and Child Care Reporting Requirements. Licensees will submit proof of completion to Licensing Fresno Office by 04/17/2024.

Based on interview and record review, the licensees did not comply with the section cited above. Adult household member had been living in the home since 12/2022. Adult household member did not have background clearance associated with this facility. This poses an immediate health, safety, or personal rights risk to children in care.

Resolution: Per Licensees, they agreed to immediately take Adult household member to complete her background clearance and submit proof of background clearance to Licensing Fresno Office by 04/08/2024.

LPA observed a built in-ground pool in the backyard. Based on observation, the pool fencing did not meet the requirement as followed: the metal fence was not at least five high, plastic turquois netting fabric was installed around the fencing obscuring the view of the pool. The gate was not swing away from the pool, the gate was not self-close and self-latching, the device of the self-closing/latching are not located no more than six inches from the top of the gate.

Resolution: Per Licensees, they will immediately made the backyard inaccessible to the children in care auntil they install metal fence, a metal gate swing away from the pool that is self-close and self-latching device located no more than six inches from the top of the gate. Licensees will submit proof to LPA by 04/08/2024.
