GUEVARA-ESPINOZA, MAGALI FAMILY CHILD CARE

Based on observation, the licensee did not comply with the section cited above. LPA observed a built-in swimming pool located in the backyard and there are two windows and a door that provided direct access to the pool area. One window is from the daycare living room. The second window and the door lead from the detached garage next to the house. A $500 civil penalty was assessed. This poses an immediate health, safety, or personal rights risk to children in care.

Resolution: During this inspection, Licensee confirmed and provided proof that the living room window will be replacing with a stationary window. The construction of replacing the window will start immediately. Licensee confirmed that the window and door from the detached garage will be permanently removed and replaced with wall. Licensee provided proof that the material for the removal of the window and door from the detached garage has been ordered and will start immediately.

Based on observation, the licensee did not comply with the section cited above. LPA observed the gate opened away from the pool; however, LPA observed that the gate is not self-closing and self-latching onto the lock device. This poses an immediate health, safety, or personal rights risk to children in care.

Resolution: Per Licensee, she will immediately repair the gate in order for the gate to be self-closing and self-latching to the lock device. Licensee will submit Proof of Correction (POC), indicating that the gate is self-closing and self-latching on the lock device, to Licensing Office-Fresno by 03/25/2024.
