Based on observation, the licensee did not comply with the section cited above by providing care to eight children none of which are enrolled and attending elementary school, with no assistant present, which poses an immediate health, and safety risk to persons in care.
Resolution: Licensee stated she will create a wrtiten schdule including the presence of an assistant. Licensee will also record a week of attendance of children and staff present to demonstrate maintaining capacity and ratio.

Based on record review and interview with Licensee, the licensee did not comply with the section cited above by stating that she remains in the room with the sleeping infants to observe the infants are not in distress, but she does not document the observations she makes which poses a potential health, safety or personal rights risk to persons in care.
Resolution: Licensee states she will begin to record 15 minute sleep checks and will email a sample of sleep checks to LPA Perez
