Based on observation, interview, and record review, the licensee did not comply with the section cited above due to the presence of an adult living in the home who did not complete the necessary steps to receive a criminal record exemption after their clearance was deemed no longer valid. This poses an immediate health, safety or personal rights risk to persons in care.
Resolution: The adult whose criminal record clearance is no longer valid will move out of the home tomorrow and the licensee understands that they cannot return to live in the facility until a criminal background exemption is obtained. LPA will conduct a return visit to ensure compliance with this POC.
