101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.

(g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children.

Criminal Record Clearance: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1)Obtain a California clearance or a criminal record exemption as required by the Department. This requirement has not been met as evidenced by: Based on interviews and records Brionna Acker and Jasmin Zafra have been in the center with the children in care without a criminal record clearance, which poses an immediate danger to children in care.

Lead Testing Written Directive: A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement has not been met as evidenced by: Based on center records water supply C1 (in the primary two classroom) and E1 (outside in the main yard) tested above 5.5 ppb which poses a potential risk to the health and safety of the children in care.

Based on observation and record review, the licensee did not comply with the section cited above only 11 children out of 24 were signed for the day which poses a potential safety risk to persons in care.

Responsibility for Providing Care and Supervision- No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement has not been met as evidenced by: Based on interviews and reviewed evidence the center has had unqualified staff providing care to the children, which is an immediate danger to children in care.

(g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children.

Based on observation and record review, the licensee did not comply with the section cited above only 11 children out of 24 were signed for the day which poses a potential safety risk to persons in care.
